These Terms & Conditions ("Terms") govern your use of the Dialed In: Focus for Closers mobile application ("the app"), provided by Mambaworks ("we," "us," "our"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

The app is intended for real estate professionals and other adults. You must be at least 18 years old (or the age of majority in your jurisdiction) to use it. By using the app you represent that you meet this requirement.

2. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices that you own or control, solely for your own use and in accordance with the Apple App Store Terms of Service. You may not sell, rent, sublicense, distribute, reverse engineer, decompile, or attempt to derive the source code of the app, except to the extent such restriction is prohibited by applicable law.

You are solely responsible for the leads and phone numbers you add and for ensuring that any calls you place comply with all applicable laws.

4. Self-accountability tool

Dialed In is a self-accountability tool. It is not a parental-control, employee-monitoring, or device-lockdown product. The "shield" is a focus aid that you configure for yourself, and you remain in full control of your device and your iOS settings at all times. You can change your goal, change which apps are shielded, or revoke Screen Time permission whenever you choose. We make no guarantee that the app will prevent you from accessing any app or improve your productivity, calling outcomes, sales, or any business result.

5. Phone calls & carrier charges

The app helps you place calls using your device's standard phone dialer. iOS shows a confirmation prompt before each call. Any calls you place are carried by your mobile carrier and may be subject to your carrier's rates and charges. We do not place calls on your behalf, do not provide telephone service, and are not responsible for call quality, connectivity, or carrier charges. The app counts calls on an honor-system basis to help you track progress; it does not verify, record, or audit the calls you make.

6. Screen Time features

The app uses Apple's Screen Time (Family Controls and Managed Settings) APIs to shield the apps you select. These features depend on Apple's frameworks and your device settings, and may change, be unavailable, or behave unexpectedly due to factors outside our control, including iOS updates and your own permission choices. The shield is not tamper-proof and is not intended to be — it is a self-imposed focus aid.

7. Your content

You retain all rights to the leads, contacts, notes, and other information you enter into the app ("Your Content"). Your Content is stored only on your device. Because we have no servers and no access to your device, we do not host, back up, or have the ability to recover Your Content. You are responsible for maintaining your own backups (for example, through your device or iCloud backup) and for the legality of the information you store.

8. Privacy

Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference. In short, the app does not collect, transmit, or share your personal data — everything stays on your device.

9. Intellectual property

The app, including its design, code, text, graphics, logos, and the "Dialed In" name, is owned by Mambaworks and protected by intellectual property laws. Except for the limited license granted above, these Terms do not transfer any rights to you.

The app is licensed, not sold, to you and is distributed through the Apple App Store. You acknowledge that:

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that it will meet your requirements or produce any particular result.

12. Limitation of liability

To the maximum extent permitted by law, Mambaworks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the app. Our total liability for any claim relating to the app will not exceed the amount you paid for the app, or USD $10 if you paid nothing.

13. Changes to the app or Terms

We may update, modify, or discontinue the app (or any feature of it) at any time. We may also revise these Terms from time to time; when we do, we will update the "Last updated" date above. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.

14. Termination

These Terms apply for as long as you use the app. You may end them at any time by deleting the app. We may suspend or terminate your license if you breach these Terms. Provisions that by their nature should survive termination (including sections 7–12) will survive.

15. Governing law

These Terms are governed by the laws of the United States and the state in which Mambaworks is established, without regard to conflict-of-law principles. Nothing in these Terms limits any rights you may have under the mandatory consumer-protection laws of your country of residence.
